EU Treaty Rights in Ireland: Residency & Citizenship for Non-Irish Citizens
If you’re a non-EU citizen with close family ties to an EU national living in Ireland, you may be entitled to residency—and even a path to citizenship—under EU Treaty Rights. At Gibson & Associates LLP, we make the process clear, fast, and tailored to your future.
What Are EU Treaty Rights?
EU Treaties allow EU citizens to live and work in any EU country—and bring their non-EU family members with them. In Ireland, this is governed by the Directive 2004/38EC as transposed by the European Communities (Free Movement of Persons) Regulations 2015.
These rights enable EU citizens to live, work, study, or be self-sufficient in another EU country or member state—and crucially, to be joined by their non-EU family members
Who Can Apply Under EU Treaty Rights?
Qualifying Family Members
These include:
- Spouses or civil partners
- Children under 21 (including those of the spouse)
- Dependent Child or Grandchild
- Dependent parents or grandparents (including those of the spouse)
- Adopted children (with legal documentation)
Qualifying family members can apply using Form EUTR1 and are typically granted temporary residence while their application is processed
Permitted Family Members
These are individuals with a close relationship to the EU citizen, such as:
- Unmarried (de facto) partners
- Household members
- Dependent relatives
- Family members with serious health conditions requiring care
Permitted family members must apply using Form EUTR1A and are not automatically granted temporary residency during processing, making legal guidance especially valuable. Each category has different application forms and requirements. We’ll help you determine the right path.
What are the Benefits of Residency Under EU Treaty Rights?
Once granted, EU Treaty Rights-based residency allows you to:
Live and work in Ireland legally
Be self-employed or pursue education
Access public healthcare and services
Leave and re-enter Ireland similarly to Irish citizens (note: this does not extend to other countries)
Begin your journey toward Irish citizenship

- Have 1 year of continuous residence immediately before applying
- Show good character and intention to reside in Ireland
- Provide supporting documentation (e.g. residence cards, proof of address, employment records)
