How Gibson & Associates Support You When Switching or Remortgaging Your Property
Switching mortgages can help you access better rates, lower your repayments, or release equity — but it also involves a series of important legal steps. At Gibson & Associates, our property team ensures the entire process is handled efficiently, transparently, and with your best interests at heart.
Here’s how we support you through each stage of your mortgage switch:
1. Taking Your Instructions and Reviewing Your Current Mortgage
We start by gathering details about your current mortgage and property. Our solicitors review your title deeds and confirm ownership to identify any potential legal issues before the process begins — keeping everything on track from the start.
2. Requesting Your Title Deeds from Your Existing Lender
We contact your current lender directly to obtain your title deeds. These documents are essential for preparing your new mortgage, and our team ensures they’re received quickly to avoid unnecessary delays.
3. Reviewing Your New Loan Offer
When your new lender issues a formal loan offer, we review it carefully and explain all terms and conditions in plain language. We’ll highlight any special conditions, ensure they match what was agreed with your mortgage advisor, and provide independent legal advice before you sign.
4. Carrying Out Legal Searches and Checks
To protect you and your new lender, we complete all necessary Land Registry or Registry of Deeds searches. This confirms that your property has a clear title, free from hidden charges, judgments, or restrictions that could affect your mortgage.
5. Preparing and Executing the New Mortgage Documents
Our solicitors prepare the new Mortgage Deed (or “Charge”) for you to sign. We ensure all legal formalities are followed, that the documents are properly executed, and that your new lender’s requirements are met in full.
6. Redeeming Your Existing Mortgage
Once the new mortgage funds are released, we handle the repayment of your existing mortgage in full. We obtain a Deed of Release from your previous lender and ensure your old charge is removed from the title — leaving your property correctly registered under your new mortgage.
7. Registering Your New Mortgage
We take care of registering the new mortgage with the Property Registration Authority (PRA). This ensures your new lender’s interest is correctly recorded on the title and that the legal transfer is fully complete.
8. Final Reporting and Returning Your Title Deeds
After registration, we provide a final report to your new lender confirming completion. We send your updated title deeds to your lender for safekeeping and provide you with a copy of the registered documentation for your own records.

Warren Sexton, is a stellar solicitor. I go to Gibson and associates for all my legal representation and I have found all of their solicitors are very easy to work with. Warren represented me very well through the purchase of a house in Ireland.
I currently live in the USA and so the logistics were a bit complicated but Warren made the purchase easy.
