Defending a Complex High Court Estate Dispute

Contested estate litigation often extends beyond the terms of a will, involving complex legal and equitable principles such as proprietary estoppel, trusts, and succession law. These cases require careful analysis, strategic litigation management, and a thorough understanding of the duties and obligations of Personal Representatives.

Background

Representing Personal Representatives in Contested Estate Litigation

Gibson & Associates Solicitors acted on behalf of the Personal Representatives of an estate in High Court proceedings involving competing claims to a family home and lands.

The proceedings concerned allegations that promises had been made during the deceased’s lifetime regarding the future ownership of the property, notwithstanding the terms of the deceased’s final will. The case involved complex issues of succession law, proprietary estoppel, promissory estoppel, constructive trusts, alleged agreements relating to land and unjust enrichment.

The Claims

The proceedings sought a broad range of equitable and legal remedies, including:

A declaration that the claimant was entitled to ownership of the family home and lands.

Specific performance of the alleged agreement to transfer the property.

Orders requiring the Personal Representatives to transfer the property.

A declaration that the property was held on trust for the claimant.

Reimbursement of monies allegedly expended on the property.

Compensation based on alleged unjust enrichment.

Damages for alleged breach of representations and agreements.

Such further relief as the High Court considered appropriate.

Outcome of Case

Estate disputes often involve far more than the interpretation of a will. Claims based upon promises made during the lifetime of the Deceased, financial contributions or long-term care can give rise to complex equitable issues requiring careful consideration by the High Court.

Defending such proceedings requires a detailed analysis of all documents, financial records, property documentation, medical records and also the evidence provided by key witnesses. These disputes are often highly sensitive, involving family relationships spanning many years, and require both technical legal expertise and a strategic approach to litigation.
