Background

Our client, an employee in an industrial setting, sustained injuries while carrying out routine inspection duties. He slipped on a build-up of industrial residue on a stairwell—an area that should have been regularly maintained—and fell into a concrete-lined section below, suffering injuries to his back and head. The incident had a direct impact on his ability to work and on his day-to-day functioning.

While the circumstances pointed to a clear failure to maintain a safe working environment, the case was not straightforward. The defendants contested the extent of the injuries and required strict proof of loss, a common approach in workplace litigation aimed at limiting exposure. The case therefore required not only establishing how the accident occurred, but demonstrating that it arose from preventable safety failures within the employer’s systems.

Outcome of Case

We implemented a structured litigation strategy focused on identifying and evidencing the underlying safety failures. This included examining maintenance protocols, inspection systems, and whether appropriate steps had been taken to prevent hazardous build-up in a high-risk area. We worked closely with our client to build a clear factual narrative and to identify any systemic shortcomings in workplace practices.

Medical evidence was central. We engaged experts to assess the full extent of the injuries and to establish causation, ensuring the claim was robustly supported in response to the defendants’ position. In parallel, we quantified the financial impact of the injuries, including any loss of earnings. High Court proceedings were issued to protect our client’s position and to ensure the matter progressed with appropriate urgency.

Our approach was proactive and strategic—addressing likely points of dispute early, maintaining momentum in the proceedings, and positioning the case strongly for resolution.

How G&A Supported This Client

A favourable resolution was achieved, reflecting both the strength of the liability case and the quality of the supporting evidence. Importantly, the matter concluded without the need for a full hearing, avoiding further stress and delay for our client.

The outcome demonstrates the importance of a disciplined approach to both liability and quantum. By clearly establishing the employer’s failure to maintain safe conditions and effectively addressing challenges to the medical evidence, we secured a result that properly recognised the impact of the accident. Beyond compensation, the case reinforces the principle of accountability where workplace safety standards fall short.
This case reflects our experience in handling workplace accident claims involving unsafe systems of work. We regularly advise on matters where operational failures intersect with legal duties, and we understand how to investigate, evidence, and present those failures effectively.

Our litigation approach is grounded in experience. We anticipate common defence strategies, particularly in relation to injury disputes, and prepare cases accordingly. Early analysis and thorough preparation allow us to strengthen our clients’ positions from the outset.

We also prioritise clear, practical communication. Clients are guided through each stage of the process with a focus on transparency and efficiency. Our objective is to deliver strong outcomes while maintaining a professional and client-focused service throughout.

Thoughts from our legal team

From a leadership perspective, cases like this highlight a recurring issue: preventable risks arising from gaps between safety procedures and their implementation. There is often a failure not in policy, but in execution.

Our focus is on identifying the core failure early and building the case around it. This creates clarity, strengthens the legal position, and supports effective resolution. It also reflects a broader commitment to consistency—ensuring each case benefits from structured processes, experienced oversight, and a high standard of preparation.

We view each matter not only as a legal claim, but as part of a wider responsibility to uphold safety standards. Where those standards are not met, our role is to achieve meaningful outcomes for our clients while reinforcing the importance of accountability in the workplace.

Excellence in legal practice means standing firm in principles while adapting to change. Our profession isn’t just about law — it’s about people, progress, and accountability.
