What Is a Power of Attorney and Why Might You Need One?

Whether you’re travelling abroad, dealing with an unexpected illness or injury, or experiencing a decline in mental capacity, a power of attorney ensures your affairs are handled effectively and according to your wishes.
In Ireland, there are two main types of powers of attorney: ordinary and enduring. Each serves a different purpose and is suited to different situations.

Ordinary Power of Attorney

An ordinary power of attorney is a temporary arrangement that allows someone to act on your behalf for a specific period or purpose. It is useful when you need assistance with financial transactions, business dealings, or legal matters but still have the mental capacity to oversee your affairs. This can cover:

  • Can be specific (limited to a particular task) or general (allowing broad decision-making powers).
  • Is valid only as long as you retain mental capacity.
  • Can be revoked at any time by the person granting it.

If you’re unable to make decisions due to illness or cognitive decline, an ordinary power of attorney will become invalid. In this case, an enduring power of attorney is essential, allowing a trusted person to manage your affairs on your behalf.

An enduring power of attorney is designed to take effect if you are no longer able to make decisions for yourself. Unlike an ordinary power of attorney, an enduring power of attorney remains legally valid even if you become mentally incapacitated. This can cover:

  • Financial affairs, such as managing bank accounts, paying bills, or handling property transactions.
  • Personal care decisions, including healthcare choices and living arrangements.
  • Setting up an enduring power of attorney requires more legal safeguards, including:
  • Medical confirmation that you are of sound mind when making the document.
  • Legal certification from a solicitor that you understand the implications of the arrangement.
  • A formal registration process if the enduring power of attorney needs to be activated in the future.

While this can cover healthcare-related decisions, it does not extend to end-of-life care or life-support decisions, which require an Advance Healthcare Directive.

Responsibilities of the Attorney

An attorney is the person you appoint to take care of your affairs under a general power of attorney agreement. Their responsibilities could include handling financial matters, conducting business transactions, and managing assets. However, the powers granted depend on the specific terms outlined in the power of attorney document. You can impose restrictions or provide broad decision-making powers, depending on your needs and how much you trust your attorney.
Under an enduring power of attorney, the attorney’s role expands to making decisions on your behalf in the event you lose mental capacity. This can include financial management, property transactions, and personal welfare decisions such as healthcare arrangements. The attorney must always act in your best interests, robustly follow the guidelines set out in the power of attorney document and comply with legal obligations. While an attorney may be permitted to sell property or access financial assets, they must act responsibly and transparently, keeping detailed records of their actions. Despite these broad powers, an attorney is bound by legal and ethical responsibilities. They cannot:

  • Make a will on your behalf.
  • Transfer assets for personal gain.
  • Act beyond the powers granted in the document.

Their role is strictly limited to acting in your best interests and within the boundaries of the law.
A power of attorney ceases to be valid upon your death, at which point your estate is managed through your will (or intestacy laws if you don’t have one).

Revoking or Changing an Attorney

It is not set in stone and can be modified or revoked while you are mentally fit. You can choose to:

  • Amend the document to reflect new preferences.
  • Appoint a different attorney.
  • Formally revoke the power of attorney through a legal revocation document.
  • Inform the attorney and relevant institutions of the revocation.

In the event the attorney is no longer able or willing to act on your behalf, the power of attorney may need to be reassessed. In some cases:

  • A new attorney can be appointed.
  • Court intervention may be necessary if no replacement is available.

If an enduring power of attorney has been activated based on mental incapacity, but that situation later changes, a legal process can be followed to revoke the document, provided medical assessments confirm the ability to make independent decisions once again.
Attorneys are closely monitored, and if found to misuse their authority, legal steps can be taken to remove them and recover any misused assets. It’s also important to note that powers of attorney created outside of Ireland may not be automatically valid here. If you hold a foreign power of attorney, seeking legal verification is essential to ensure it is recognised under Irish law.
