Very professional
Gibson & Associates LLP recently handled a case for me with a very successful outcome. From the outset Jessica and the team listened and understood my concerns and dealt with the case in a very professional manner.
What is Litigation?
Litigation is a legal process used to settle disagreements. It usually refers to a legal case being brought in front of a judge in court, although litigation can also include alternative dispute resolution approaches like mediation or arbitration. Disputes are usually taken to court when all other negotiation options have been exhausted.
What kind of cases can be resolved using our litigation services?
- Judicial Review
- Challenging a Will or Probate
- Defamation
- Property & Boundary Disputes
- Employment Law
- Insurance Arbitration
- Family Law in Ireland
- Defective Product Claims
- Debt Collection & Recovery
- Contract Disputes
- Professional Negligence
Judicial Reviews
When an individual or group of people believe a decision made by a public authority or state entity has infringed upon their rights, they can approach the High Court to request a judicial review of the decision. In Ireland, judicial reviews primarily examine how the decision-making process was carried out by the relevant authority, rather than considering the merits of the decision itself.
Challenging a Will or Probate
The process of dealing with a will or probate can turn into a source of dispute when a beneficiary or someone excluded from an inheritance decides to contest it.
People challenge Wills, Trusts, or Estates for various reasons, often due to doubts about the validity of the Will or concerns the executor may have acted negligently.
Defamation
Defamation is a false statement presented as fact that causes injury or damage to the character of the person or organisation the statement is made about.
There are two types of defamation, Libel and Slander. Libel is referred to as a written form of defamation, while slander is spoken form of defamation.
Property & Boundary Disputes
Property disputes can be complex and need a legal process to resolve them.
Property disputes are often the result of disagreements over property lines, responsibility for repairs on construction, blocked views, rightful ownership, zoning issues, and disagreements over who is at fault for property damage.
Employment Law
It’s important for both employers and employees to understand their rights and responsibilities in the workplace. Issues such as remuneration, redundancies, and workplace disagreements can lead to disputes that can be resolved under Irish employment law.
Insurance Arbitration
When an insurance company and a policyholder disagree on the terms of a settlement, it can lead to an insurance dispute. Examples of an insurance dispute include an insurance company outright rejecting a claim, offering a payout less than the claimant believes their damages are worth, or unexpectedly postponing a payout.
Family Law in Ireland
Family law deals with issues involving family relationships such as marriage, adoption, divorce, and child custody.
Solicitors practicing family law can represent clients in family court proceedings and other negotiations.
Defective Product Claims
A defective product claim may arise when someone suffers a personal injury due to a design or manufacturing flaw in a product. To establish a defective product design, evidence is needed to demonstrate the product carries a danger that is not obvious to the naked eye.
Debt Collection & Recovery
If you’re owed a debt and struggling to collect it from your debtor, you might start the debt recovery process with help from a debt collection solicitor. This can be a crucial step in reclaiming what you’re owed.
Contract Disputes
When entering into a contract, each party is legally obliged to adhere to the terms set out in the document.
Contract disputes arise when two parties have a different understanding of the requirements, limitations, or compensation for a contract.
Professional Negligence
When a professional falls short in delivering their services to an acceptable standard, and this leads to a financial loss to you, this is considered professional negligence. Professional services may include medical, legal, accounting, and similar service areas.
