Statutory and Evidential Issues
This matter required careful analysis of a number of interrelated statutory and evidential issues. Under Irish law, only full (plenary) adoptions; those which permanently extinguish the legal relationship between the child and the biological parents, are capable of recognition. It was therefore necessary to demonstrate that the Guatemalan adoption effected in 2005, together with its subsequent certification by the New York court in 2022, constituted a full adoption equivalent in legal effect to an adoption granted under Irish law.
A further layer of complexity arose from the transitional legislative framework. While the original adoption clearly pre-dated the commencement of the Adoption Act 2010, the 2022 New York court order introduced a post-2010 element, creating potential ambiguity as to the appropriate statutory classification. Submissions were accordingly prepared addressing both possible frameworks to ensure that the application could proceed without delay or mischaracterisation.
In addition, the Adoption Authority required detailed confirmation of the applicant’s habitual residence at the relevant times, the assessment of her eligibility and suitability to adopt in the United States, and the regulatory oversight of the agency involved.
This necessitated the collation and structured presentation of extensive supporting documentation to demonstrate that the procedures followed were broadly analogous to those required under Irish law. An Affidavit of Laws from a practising U.S. adoption attorney was also required to clarify the legal effect of the Guatemalan adoption, its recognition under New York law, and its equivalence to a full Irish adoption. The affidavit had to be prepared strictly in accordance with the Adoption Authority’s criteria and authentication requirements.
