We adopted a comprehensive litigation strategy, issuing High Court proceedings by way of Plenary Summons and detailed Statement of Claim. The claim was carefully structured to address each strand of wrongdoing, including unlawful repossession, trespass to land and goods, and multiple breaches of statutory duty under data protection legislation.
Our approach was evidence-led and highly forensic. We analysed the sequence of events surrounding the repossession, focusing on the absence of any lawful basis for the taking of possession. In parallel, we developed a detailed evidential record of the ongoing data processing failures, including repeated inaccurate communications, erroneous credit reporting, and systemic deficiencies in the defendant’s data management practices.
Particular emphasis was placed on demonstrating the cumulative impact of these breaches. Rather than treating each issue in isolation, we presented the case as a pattern of conduct reflecting a failure to implement appropriate technical and organisational measures, as required under the GDPR. This included failures in accuracy, transparency, and accountability in the processing of personal data.
At all stages, we maintained a dual focus: progressing the litigation to protect our client’s position while remaining strategically open to resolution. Through sustained engagement, detailed pleadings, and the application of consistent legal pressure, we advanced the matter toward a position where meaningful settlement discussions could take place.
The Results
The matter was ultimately resolved by way of a negotiated settlement, bringing full and final closure to all issues between the parties.
