Background

Our firm was instructed in a High Court estate dispute arising from concerns that proper provision had not been made under a deceased parent’s will. The matter involved a challenge under Section 117 of the Succession Act 1965, centring on whether the deceased had failed in their moral duty to make adequate provision for their children in light of their means and the overall circumstances of the estate.

The factual matrix was complex. While the Will made some provision, the majority of the estate had been left to a third party, giving rise to concerns that the testamentary arrangements did not reflect a fair or reasonable distribution. In addition, there were issues regarding certain dispositions of assets prior to death, with questions as to whether those transactions had the effect—intended or otherwise—of diminishing the estate available to the applicants. These issues required careful forensic analysis and a clear evidential strategy.

Beyond the legal complexities, the case carried a significant emotional dimension. Estate disputes of this nature often involve fractured family relationships and deeply held positions. The challenge was therefore twofold: to advance a strong legal case capable of withstanding scrutiny, while managing the sensitivities inherent in intra-family litigation. It was also necessary to consider protective measures to ensure that estate assets were preserved pending the determination of the proceedings.

Outcome of Case

We adopted a strategic and evidence-driven litigation approach, issuing High Court proceedings by way of Special Summons grounded in detailed affidavit evidence. The claim sought a range of reliefs, including declarations regarding failure of moral duty and, where appropriate, orders addressing the validity and effect of prior dispositions. This ensured that all potential avenues for relief were preserved and clearly articulated from the outset.

Our focus was on building a robust evidential framework. This involved a detailed review of the testamentary documents, the surrounding financial circumstances, and the broader context in which the will was made. We carefully analysed the extent of the estate, the nature of the provision made, and the competing claims of all interested parties. Where necessary, we considered the implications of transactions within the relevant statutory period and their potential impact on the estate available for distribution.

At the same time, we maintained a clear strategic objective: to achieve a resolution that would provide certainty and finality while protecting our client’s entitlement. We engaged proactively with the opposing side, testing the strength of their position and advancing our client’s case in a structured and measured manner. By progressing the proceedings while remaining open to meaningful engagement, we created the conditions for resolution without compromising our client’s position.

The Results

Following sustained engagement and procedural progression, the matter was resolved by way of a Court-approved settlement, bringing full and final resolution to all claims arising from the estate.

The outcome delivered:

  • A comprehensive settlement of all disputes concerning the estate
  • Agreement between the parties to conclude the proceedings without further litigation
  • A structured resolution providing certainty and closure for all involved

Importantly, the resolution avoided the need for a contested High Court hearing. This significantly reduced the emotional strain and financial exposure typically associated with fully litigated succession disputes, while still achieving a clear and enforceable outcome. The agreement brought finality to what had been a complex and sensitive dispute, allowing all parties to move forward with certainty.
