Background

Our client became involved in a protracted boundary dispute with a neighbouring landowner arising from uncertainty as to the true legal boundary between the properties. What initially appeared to be a minor disagreement escalated into a significant issue involving allegations of encroachment, interference with property rights, and the positioning of boundary structures. The dispute was compounded by inconsistencies between Land Registry folio maps and historical title deeds, creating ambiguity as to the precise legal boundary.

The situation had immediate practical consequences. Our client’s use and enjoyment of their property was affected, and the existence of an unresolved dispute posed a potential barrier to any future sale or refinancing. Attempts at informal resolution had broken down, with both parties maintaining conflicting interpretations of the boundary line. The absence of clear, agreed evidence meant that the matter risked becoming increasingly entrenched, with the potential for costly and time-consuming litigation.

The core challenge was to establish the correct legal boundary in a manner that was both evidentially robust and commercially sensible, while avoiding unnecessary escalation where possible.

Outcome of Case

We adopted a structured and evidence-led approach, recognising that boundary disputes in Ireland are ultimately determined by a careful analysis of legal documentation supported, where necessary, by expert input. Our initial focus was on assembling and analysing all relevant materials, including title deeds, Land Registry folios, historical maps, and any available documentary evidence relating to the properties.

Where discrepancies arose between mapping and deed descriptions, we advised on the legal principles governing priority, including the primacy of clear deed-based descriptions over general boundary mapping. We also engaged with appropriate expert input to assist in clarifying the physical position on the ground and aligning this with the legal documentation.

At the same time, we maintained a strong emphasis on achieving a practical resolution. We engaged directly with the neighbouring party, setting out our client’s legal position in a clear and structured manner, supported by the evidence gathered. This allowed us to move the discussion from competing assertions to an objective analysis of the boundary.

While we remained fully prepared to initiate formal proceedings if required, our strategy was focused on resolving the matter through informed negotiation. By combining legal clarity with a measured and commercially aware approach, we were able to create the conditions necessary for resolution without immediate recourse to court intervention.

The Results

  • Through a combination of detailed legal analysis and strategic engagement, the dispute was brought to a successful conclusion:
  • The correct legal boundary was established based on a clear interpretation of the title documentation and supporting evidence
  • Agreement was reached between the parties, avoiding the need for contested court proceedings
  • The issue of encroachment was resolved on mutually acceptable terms
  • Our client’s property rights were fully protected and clarified

The resolution provided certainty and removed a significant obstacle to the future use and potential sale of the property. Importantly, it avoided the cost, delay, and adversarial nature of litigation, while still delivering a legally robust outcome.

How G&A Supported This Client

Expertise, Experience, Authoritativeness and Trustworthiness

This case highlights our firm’s depth of expertise in property and boundary disputes, an area that often requires a detailed understanding of both legal principles and practical realities. Boundary disputes are rarely straightforward; they frequently involve a combination of legal interpretation, historical documentation, and technical surveying evidence.

Our experience allows us to identify the key issues quickly and to focus on the evidence that will ultimately determine the outcome. We understand the nuances of Land Registry mapping, the evidential weight of title deeds, and the role of expert input in resolving ambiguities. This enables us to provide clear, authoritative advice at an early stage, reducing uncertainty for our clients.

We adopt a pragmatic and solution-focused approach. While we are fully equipped to pursue litigation where necessary, our priority is always to achieve the most effective and efficient resolution. In many cases, this involves using our legal analysis as a foundation for structured negotiation, as demonstrated in this matter.

Trust and transparency underpin our client relationships. We recognise that property disputes can be both stressful and disruptive, particularly where they involve neighbouring parties. We ensure that our clients are fully informed at each stage, with clear advice on risks, options, and likely outcomes. This allows them to make confident decisions while remaining in control of the process.

Thoughts from our legal team

From a leadership perspective, boundary disputes are among the most underestimated forms of legal conflict. What may begin as a minor disagreement over a fence or boundary line can quickly escalate into a deeply entrenched dispute with significant legal, financial, and personal consequences.

Our view is that early, evidence-led intervention is critical. Too often, parties rely on assumptions or informal understandings of boundaries rather than the underlying legal documentation. By addressing the issue at its root—through deeds, mapping, and expert analysis—it is possible to bring clarity to even the most complex disputes.

This case also reinforces the importance of proportionality. Not every dispute requires immediate litigation. A carefully structured approach, combining legal authority with measured negotiation, can often achieve a more efficient and less adversarial outcome.

Ultimately, our role is to bring clarity, control, and resolution to situations that have become uncertain and contentious. This case demonstrates how a disciplined, strategic approach can transform a potentially protracted dispute into a clear and final outcome for the client.

Excellence in legal practice means standing firm in principles while adapting to change. Our profession isn’t just about law — it’s about people, progress, and accountability.
